US Gas and Electric Lawsuit

Lite DePalma Greenberg, LLC filed a class action against US Gas & Electric, Inc. (USG&E) and Energy Service Providers, Inc. (ESPI) alleging that they engaged in fraud and violated consumer protection laws by misrepresenting how they price their gas and electric services.

Independent energy supply companies (ESCOs), like USG&E and ESPI, are permitted to supply electricity and natural gas to homes and businesses at prices based on market rates. When energy is relatively inexpensive, ESCOs are able to lure in new customers with the promise of significant cost savings.

However, when the demand for energy rises sharply, so must the cost of energy. Customers should know that prior to switching energy suppliers.

USG&E and ESPI allegedly enticed new customers to switch suppliers by promising “competitive” pricing, but they failed to disclose that, during periods of extreme cold weather, the cost of energy would skyrocket. During the winter of 2013-2014, for example, USG&E and ESPI charged some customers as much as double – or even triple – what local utilities were charging. There is nothing competitive about that.

You may know USG&E and ESPI by another name depending on where you live, but their operating names all fit the same pattern: the name of the state, followed by “Gas & Electric.” In New Jersey, for example, they do business as New Jersey Gas & Electric (NJG&E), but, in New York, they are New York Gas & Electric (NYG&E).
